Terms of Service
The agreement for using Twifly — what the Service does, your responsibilities when you connect and automate an X (Twitter) account, and how billing works.
1. Agreement to these terms
Twifly is operated by Karuppanan, trading as Twifly ("Twifly", "we", "us"). These draft Terms of Service ("Terms") describe the proposed agreement for using the Twifly web application, browser extension, and marketing site (the "Service"). Questions can be sent to [email protected]. The Privacy Policy explains how we handle personal information; acknowledging it is separate from granting optional Analytics consent.
You must be at least 18 years old, or the age of majority where you live, to use Twifly. If you use Twifly on behalf of an organisation, you confirm you are authorised to accept these Terms for it.
Twifly is an independent product and is not affiliated with, endorsed by, or sponsored by X Corp.
2. What Twifly provides
Twifly is a web workspace for X: publishing posts and threads, scheduling and queues, audience discovery, engagement campaigns, direct-message workflows, RSS drafting, activity history, and campaign reporting. Available features depend on your subscription plan.
We may add, change, or remove features over time. We aim to give notice of material changes but are not obliged to maintain any particular feature indefinitely.
3. Your Twifly account
You are responsible for the information you provide and for keeping your login credentials secure. You are responsible for all activity that happens under your account. Tell us promptly at [email protected] if you believe your account has been compromised.
4. Connecting and automating an X account
To use Twifly's automation you connect an X account, which authorises Twifly to act as your logged-in X session and take the actions your campaigns and tools are configured to take (see the Privacy Policy for how that session is stored). This is the most important part of these Terms, so please read it carefully.
- You may only connect an X account that you own or are authorised to operate, and you must have the right to automate it.
- You are solely responsible for complying with X's Terms of Service, developer and automation rules, and any other rules X applies to your account. Those rules are set by X and can change at any time.
- Automating an X account carries risk. X may rate-limit, restrict, suspend, or permanently ban an account for automated activity. You accept that risk, and to the maximum extent permitted by law Twifly is not responsible for any action X takes against your account, or for any loss of followers, content, reach, or access that results.
- You control the automation. You set the actions, filters, daily limits, schedules, and run windows. The limits and safety controls Twifly provides are tools to help you moderate activity; they do not guarantee compliance with X's rules or any particular outcome.
5. Acceptable use
You agree not to use Twifly to:
- Send spam or unsolicited bulk messages, harass, threaten, or abuse anyone, or engage in coordinated inauthentic behaviour.
- Publish or promote content that is illegal, infringing, deceptive, or that violates X's rules or the rights of others.
- Automate an account you do not own or are not authorised to operate, or attempt to access another user's Twifly account or data.
- Resell, sublicense, or provide the Service to third parties except as expressly permitted by your plan.
- Interfere with, overload, reverse-engineer, or attempt to circumvent the security or access controls of the Service.
6. Plans, trials, and billing
Paid plans and their current prices, trial length, and inclusions are shown on our pricing page. Payments are processed by our payment provider, FastSpring, which acts as merchant of record and handles checkout, tax, and invoices.
A subscription starts with a trial that requires a valid payment method. Unless you cancel before the trial ends, your plan converts to a paid subscription and renews automatically for successive billing periods until you cancel. Manage cancellation from Billing and the payment provider's subscription controls. Review the displayed effective date and access status rather than assuming every cancellation keeps access through the current period.
Before confirming a purchase or plan change, review Billing and the final FastSpring checkout for the price, billing cycle, trial end, taxes, adjustments, and effective date. Do not assume a plan change is deferred or always prorated. Refund and statutory withdrawal rights depend on applicable law and the applicable checkout terms.
AI-assisted content
AI features generate suggestions from the inputs and context you provide. Requesting a generation authorises the processing described in the Privacy Policy, including retries through another enabled provider. Optional Analytics consent is separate and is not a condition of requesting AI writing.
The confirmed production AI setup uses Google Gemini through billing-enabled projects and Groq with Zero Data Retention enabled for inference requests. You must have the rights and lawful basis needed to submit material, including third-party content and personal information. Do not submit credentials, sensitive personal data, or confidential information. Google's Paid Services terms exclude use of prompts and responses for product improvement while allowing limited safety, abuse-prevention, and legally required retention. Groq's inference setting does not remove its usage metadata or Twifly's separately stored content and records. Provider-specific data handling and Twifly's separate storage are described in the Privacy Policy; we do not promise zero retention across providers.
Generated content can be inaccurate, biased, outdated, non-unique, or infringing. Check facts, permissions, tone, attribution requirements, and applicable platform rules before saving, scheduling, or publishing. Do not treat outputs as professional advice or a guarantee of growth, safety, originality, or legal compliance. You remain responsible for how you use and publish them.
You retain rights you already hold in your inputs. Rights in outputs depend on applicable law and provider terms; Twifly does not promise exclusive ownership or copyright protection. AI availability and results may change. Mandatory consumer rights are unaffected; the final allocation of liability remains subject to legal review.
7. Intellectual property and your content
Twifly and its software, design, and content are owned by Twifly and its licensors. These Terms do not grant you any right in them except the limited right to use the Service under your plan.
You keep ownership of the content you create and the data in your connected accounts. You grant Twifly the limited licence needed to store, process, and transmit that content and data for the sole purpose of providing the Service to you.
8. Third-party services
Twifly depends on services we do not control, including X, our payment provider, and other providers listed in our Privacy Policy. We are not responsible for their availability, changes, or actions, including any change X makes to its platform or rules that affects how Twifly works.
9. Disclaimers
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, to the maximum extent permitted by law. We do not warrant that the Service will be uninterrupted or error-free, that automation will comply with X's rules, or that using Twifly will produce any particular growth, engagement, or business result.
10. Limitation of liability
To the maximum extent permitted by law, Twifly will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, followers, reach, or goodwill, arising from your use of the Service or from any action taken by X against your account. Our total liability for any claim relating to the Service is [liability cap to be confirmed by counsel].
11. Indemnification
You agree to indemnify and hold Twifly harmless from claims and losses arising out of your use of the Service, your content, or your breach of these Terms or of X's rules, to the extent permitted by law. [Scope to be confirmed by counsel.]
12. Suspension and termination
You may stop using Twifly and cancel your subscription at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or if your use poses a risk to the Service or to others. On termination, your right to use the Service ends; sections that by their nature should survive (such as intellectual property, disclaimers, and limitation of liability) will continue to apply.
13. Changes to these terms
We may update these Terms as the product or the law changes. When we make a material change we will update the date below and, where appropriate, notify you. Continuing to use the Service after an update means you accept the revised Terms.
14. Governing law
The applicable governing-law and dispute-resolution provisions will be set after legal review. No jurisdiction has been selected in this draft. Nothing in these draft Terms is intended to remove rights or remedies that applicable consumer or data-protection law does not allow you to waive.
